Liability waiver

This is the waiver every booking lead-passenger e-signs after payment. You'll be asked to read and accept it as part of your booking.

CONTRACTUAL ASSUMPTION, ACKNOWLEDGEMENT OF RISKS, AND LIABILITY WAIVER & RELEASE AGREEMENT

Kindly inform us of any health conditions you may have, such as asthma, heart disease, cognitive impairment, panic disorder, breathing difficulties, or physical disabilities that may impede your involvement in water-based activities.

Prior to engaging in the activity, please inform us if you are unable to swim in open water.

IN CONSIDERATION of being allowed to participate in the events, activities, and tours provided by the Tour Operator, for myself and/or any minor children for whom I am the legal parent, guardian, or otherwise responsible, and for my/our heirs, personal representatives, or assigns:

Acknowledgement of Risks

I fully acknowledge that participation in transportation to and from (Stingray City / Coral Garden / Starfish Point) and participation in local stingray tours involves inherent risks, including but not limited to:

• Adverse weather conditions such as wind shear, lightning, and extreme temperatures
• Limitations in physical condition, balance, swimming ability, or ability to follow instructions
• Risks of collision, capsizing, sinking, or other hazards leading to injury, exposure, hypothermia, or drowning
• Exposure to insects and marine life
• Equipment failure, operator error, or transportation accidents
• Heat or sun-related illness, including sunburn, sunstroke, or dehydration
• Fatigue, chill, or dizziness affecting reaction time
• Any other activity-specific risks not listed above

I confirm that I have received adequate instructions or training for the safe use of equipment and that I am physically and mentally capable of participating in this activity.

Contractual / Express Assumption of Risk and Responsibility

I voluntarily assume full responsibility for all risks associated with this activity, whether listed above or not, including those arising from the negligence of the parties listed below.

I accept full responsibility for myself and any minor children under my care, including any injury, illness, paralysis, death, property loss, or related expenses that may occur during participation.

I understand and agree that this includes risks caused in whole or in part by negligence.

Release of Liability

I hereby release and discharge the following parties from any and all liability:

• The Cruise Line
• Caymanian Land & Sea Co-Operative
• Aon Ltd (Cayman)
• All affiliated companies, directors, officers, employees, agents, and volunteers
• Any landowners, municipalities, or governmental agencies involved
• Their respective insurers

This release applies to any injury, damage, or death resulting from participation in the activity, whether caused by my own actions or the negligence of the parties listed above.

Legal Acknowledgement

I confirm that I have read and fully understand this agreement. I acknowledge that it is legally binding and that I am waiving significant legal rights, including the right to bring claims against the parties listed above.

I agree to indemnify and hold harmless the Tour Operator and all related parties from any claims arising from my participation or that of any minors under my care.

Governing Law

This Agreement shall be governed by the laws of the Cayman Islands.

Any legal action arising from this Agreement must be brought exclusively within the Cayman Islands courts.

Authority to Sign

I confirm that I am the primary contact and am signing on behalf of all listed passengers, all of whom have agreed to these terms.
